1.1 Palumbo & Gigante may make changes to these Conditions of Sale from time to time, at its sole discretion or following subsequent provisions of law; updates will be made known to Customers by publication in the Conditions of Sale section on the website www.palumboegigante.it
1.2 Such changes will be applicable to purchase requests sent by the Customer after the date of publication of the changes themselves on the website, reported in the header of the Conditions of Sale, and will not have retroactive effect.
1.3 These Conditions of Sale govern distance selling, via the e-commerce website of Palumbo & Gigante S.r.l., having its own business in Via della Libertà 13B, 90139 Palermo Italy VAT and Tax Code 05015690828 (hereinafter for brevity Palumbo & Gigante, of the products available for sale in the specific catalogue viewable on the site www.palumboegigante.it.
1.4 Please remember that it is the exclusive responsibility of the Customer, before submitting the purchase request, to read and accept these Conditions, the text of which will always remain available and accessible to the Customer on the Site www.palumboegigante.it
1.5 Sales are reserved for Customers who have reached the age of majority (eighteen years in almost all countries). Minors do not have the right to legitimately enter into a contract and are required to use their parent or legal guardian to send a purchase request in their name and will in any case be required to accept these Conditions of Sale.
1.6 Online sales are aimed at end customers. By submitting a purchase request through the Site, the Customer represents and warrants that he or she is a bona fide customer who purchases for his or her own personal use or that of another person and that he or she will not deliver, sell or distribute our products or purchase our products or services for commercial purposes.
1.7 For Customers who are legal entities, it is not possible to complete the purchase through the Site because no invoice will be issued to any VAT number through the Site. If a legal entity completes the purchase request through the Site, the order request may be cancelled by Palumbo & Gigante.
1.8 The information and characteristics of the products are clearly described and available on the site www.palumboegigante.it. Only original items are sold on the Site. All new products offered are accompanied by an official guarantee from the respective companies and manufacturing Maisons.
1.9 Palumbo & Gigante holds the qualification of manufacturer of the Palumbo & Gigante & branded objects. Co. or Official Dealer of all brands of new items offered for sale, always guaranteeing the absolute originality, the lawful origin and the perfect integrity of the products marketed, which are always accompanied by their official kit (box and guarantee).
1.10 All images of the jewels and products published on the Site represent exactly the final product that the Customer can purchase. Some objects may appear slightly larger or smaller than the actual dimensions in order to adapt the object to the screen or due to particular photographic techniques. The colors in the images may be affected by the lights of the photographic set, reflections of other objects or the settings of the screen for viewing images in digital format.
1.11 Palumbo & Gigante takes the utmost care to ensure that the product descriptions, dimensions and colours contained on the Site are accurate and complete. However, any description or indication regarding the weight of precious materials and the number of stones and carats are provided indicatively and may vary slightly.
1.12 The prices indicated in the product sheets on the Site include VAT, but without shipping costs or other taxes, where applicable. Any shipping costs are indicated separately from the price of the selected items. In no case are shipping costs displayed on the product sheets, but will be added to the price of the product in the Cart, when selecting the destination country.
1.13 With reasonable diligence Palumbo & Gigante ensures that product prices and shipping costs are correct at the time of entry into the system. However, it is always possible that, despite reasonable efforts, some products offered on the Site or delivery costs may show an incorrect price. If one of the products for which the order is sent shows an incorrect price or in the event of an error in the shipping costs, Palumbo & Gigante will inform the customer of the error as soon as possible. If the customer cannot be reached via the contact details provided during the order process, the order will be cancelled by sending a written notification. In the event of incorrect acceptance and processing of the order by Palumbo & Gigante or errors in the delivery costs, it will be possible to cancel the delivery of the product and refund the Customer the amounts paid.
1.14 Purchase requests sent via the Site are subject to the relative availability of the purchased product, which is also available for physical sale in the Palumbo & Gigante boutiques at the same time. 1.16 In the case of sales destined for non-EU countries, the payment of duties and customs charges is in any case the responsibility and management of the Customer, who will have the support of the Palumbo & Gigante forwarder for the management of the payment and customs clearance operations. The Customer must then enter/confirm the data for shipping and billing, select the desired delivery method, read and accept the Conditions of Sale published on the Palumbo & Gigante-co.com website and, finally, proceed with the payment. It is not possible to select a shipping country different from the billing country.
1.17 Sending the purchase request (hereinafter “purchase request” or “order”) and acceptance: by sending the order via the Site, which has the value of a contractual purchase proposal, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and fully accepts these Conditions of Sale.
1.18 Once the payment procedure is completed, the Customer will be redirected to the Site page where he will find a message confirming acceptance of the purchase request; at the same time – barring technical problems – he will receive an email to the address provided with the same message.

1.20 Entering shipping data on the Checkout page: when summarizing the order on the Checkout page, if the user has not registered, he/she must enter his/her personal data including the billing and shipping address.
1.21 Billing: once the shipping data has been entered in the personal area, Palumbo & Gigante will issue the purchase invoice with the Tax Code of the “consumer” Customer, which will be available in the Personal Area of the Site. The customer – barring technical problems – will receive an email notification.
Palumbo & Gigante reserves the right, at its sole discretion, to refuse or cancel orders at any time for reasonable reasons. For example, orders may be refused or canceled if there is an ongoing dispute over the payment of a previous order or if we suspect, at our sole discretion, fraudulent activity or any violation of these Conditions of Sale.

1.22 When the order is in the “Completed” status, it is necessary to follow the withdrawal procedure. 1.23 The Customer guarantees the accuracy and truthfulness of all data and information provided to Palumbo & Gigante; no responsibility can therefore be attributed to P alumbo & Gigante if the incompleteness and/or inaccuracy of the data makes it impossible to proceed with the supply of the requested products.
1.24 The Customer, once the purchase procedure has been concluded, will keep a copy of these Conditions of Sale and any order confirmation communications, in compliance with the provisions of articles 50 and following of Legislative Decree no. 206/2005 on distance selling and articles 12 and following of Legislative Decree no. 70/2003 on electronic commerce.
1.25 Due to the precious nature of the objects handled by Palumbo & Gigante, all shipments are insured. Palumbo & Gigante covers the purchase with insurance for the time of transport and up to delivery to the customer. An adult signature is required to confirm delivery and from that moment the responsibility for the product passes to the customer.
1.26 The purchase order, once accepted by Palumbo & Gigante S.r.l., subject to payment in the manner chosen by the customer as indicated on the website www.palumboegigante.it, will be processed within 5 working days and shipped with a primary national courier within the terms specified below. In any case, the Customer has the right to collect the purchased goods directly from the Company’s points of sale upon written request that has been accepted by Palumbo & Gigante S.r.l.
1.27 It is possible to purchase on the Site products that are not available in stock and marked with the label “Product available in 4/6 working weeks”, the Customer will receive a confirmation email as soon as the product is received at our Boutiques and shipped.
1.28 The goods being sold will be shipped with a special seal in their original packaging and may be returned, subject to the exercise of the right of , only on condition that they are with their seal and their original packaging.
1.29 It is possible to purchase gift vouchers called Gift Cards. Once the purchase is completed, the customer will receive a unique code by email within 24 hours. In addition to online, Gift cards can also be spent at our Palumbo & Giant of Palermo and Termini Imerese displaying the unique code. 1.30 The sale of products from the site www.palumboegigante.it are subject to the provisions on the legal guarantee of conformity and commercial guarantees for consumer goods pursuant to applicable Community and national legislation, including Legislative Decree 206 of 2005 Consumer Code and Legislative Decree. Legislative Decree 70 of 2003 E-commerce.
1.31 Online sales are aimed at end customers. By transmitting a purchase request via the Site, the Customer declares and guarantees that he or she is a customer in good faith who purchases for his or her own personal use or that of another person and that he or she will not deliver, sell or distribute our products or purchase our products or services for commercial purposes.
1.32 If the purchase request is not complete in all its parts, or if the Customer does not provide real personal data during registration or does not make available the other data necessary for invoicing or delivery of the product; in the event of unavailability of the goods, for any reason;
in the event of failure to comply with these Conditions of Sale;
where a plausible risk of fraud is identified;
if the Customer is found to have defaulted towards Palumbo & Gigante in previous relationships of any kind or is found to have fueled the market of unofficial resale of watches.
1.33 In the event of refusal of the sale, Palumbo & Gigante will promptly notify the Customer at the email address indicated by the customer or, if the customer is unreachable, by registered mail with return receipt to the address provided. In the event of refusal of the sale for the reasons indicated above, Palumbo & Gigante will refund the sums paid by the Customer within a maximum of 15 working days from the date on which Palumbo & Gigante has communicated to the Customer, also by email, the unavailability of the product, or the existence of one of the other impediments contemplated in this article has been ascertained. The refund, unless otherwise agreed with the Customer, will be made by bank transfer or by crediting the credit card used for payment.
1.34 Upon receipt of the purchased product, the Customer is required to check whether the number of packages delivered corresponds to that indicated on the transport document and whether the packaging is externally intact. If the Customer, at the time of delivery of the goods, certifies that the sales package is not intact or damaged, he is required not to accept the delivery.
RETURN AND RIGHT OF WITHDRAWAL
Purchases made from the site www.palumboegigante.it are regulated by Legislative Decree 206 of 2005 Consumer Code and Legislative Decree 70 of 2003 E-commerce.
The products must be returned in the same conditions in which they were delivered with the original seal and packaging. The Customer has the right to receive a voucher or gift card in place of the refund of the purchase price. The return costs are the responsibility of the customer, however the Customer is also responsible for the deterioration, damage, loss, theft of the goods during the return procedure. ELECTRONIC COMMUNICATIONS
For the purposes of this contract, the Customer agrees to receive communications electronically and acknowledges that all contracts, notifications, information and other communications provided electronically satisfy the written form requirement provided by law.
APPLICABLE LAW AND JURISDICTION
These conditions are governed by and must be interpreted in accordance with Legislative Decree 206 of 2005 Consumer Code and Legislative Decree 70 of 2003 E-commerce.
If the qualification of consumer is excluded, the Customer accepts the Court of Palermo as the exclusive territorial competent Court.
