LEGAL GUARANTEE OF CONFORMITY

Palumbo & Gigante holds the qualification of manufacturer of Echo Palumbo & Gigante and Palumbo & Gigante branded objects or Official Dealer of all brands of new objects offered for sale, always guaranteeing the absolute originality, the lawful origin and the perfect integrity of the products marketed, which are always accompanied by their official kit (box and guarantee).

Pursuant to articles 128 -135 of the Consumer Code pursuant to Legislative Decree no. 206/2005, all products offered for sale on the Site are covered by a 24-month guarantee for defects of conformity existing at the time of delivery of the goods, in any case not attributable to improper use of the product by the Customer.

The guarantee does not cover:

1. damage resulting from wear and tear (such as, for example, scratches, alterations in colour, alterations/transformations of the material);
2. damage resulting from ageing:
3. damage to any part of the jewel and/or watch resulting from abnormal use;
4. damage resulting from lack of due attention, negligence, accidents (knocks, dents, impacts, etc.), incorrect use of the jewel and/or watch;
5. indirect damage of any nature that may result from use;
6. repairs of the jewel and watch carried out by third parties not authorised by the manufacturer exclude the applicability of the guarantee.

This guarantee applies exclusively if the Customer is a consumer in the sense provided for by art. 3 of the Consumer Code and therefore applies only to Customers who have made the purchase through the Site for purposes other than their entrepreneurial, commercial, artisanal or professional activity.

TERMS AND METHODS OF EXERCISE OF THE WARRANTY

Pursuant to art. 132 of Legislative Decree no. 206/2005, the lack of conformity must be reported, under penalty of forfeiture of the guarantee, within 2 months from the date on which it was discovered, by giving notice to the email address [email protected].

For those who do not qualify as Consumers, the provisions of articles 1490 et seq. of the civil code on sales will apply and therefore the report of any faults or defects must be made under penalty of forfeiture within 8 days.

If, following the checks carried out, the defect does not appear to be a lack of conformity in the sense specified by art. 129 of Legislative Decree no. 206/2005 or by art. 1490 of the Civil Code, it will not be possible to apply the legal guarantee and, consequently, any repair and shipping costs will be borne by the Customer.

In cases where the application of the guarantees involves the repair of the product, it is necessary that the goods are returned to Palumbo & Gigante S.r.l. in the original packaging, complete in all its parts so that Palumbo & Gigante S.r.l. can take care of shipping it to the parent company that will handle the repair.

Any damage due to inappropriate packaging will result in the non-acceptance of the product and the Customer will be charged for the costs of returning the goods.
