Pursuant to Legislative Decree no. 206/05, the Consumer who purchases one or more products through distance communication techniques may exercise the right of withdrawal without any penalty and without specifying the reason.
This right is reserved exclusively for “Consumer” Customers and therefore cannot be exercised by legal persons and natural persons acting for purposes related to any entrepreneurial and professional activity carried out.
All customized, modified or commissioned products are an exception (such as a ring made to the customer’s size, a watch engraved on request); for the latter, in fact, any possibility of reimbursement and/or return lapses.
Each product sold by Palumbo & Gigante S.r.l. is equipped with a special WARRANTY SEAL (green label). In case of product return, the seal must be intact, must not be tampered with or removed. Products without a seal will not be refunded.
The Consumer must exercise the right of withdrawal by sending a communication to Palumbo & Gigante S.r.l. by writing to [email protected] within 14 days from the day following the date of receipt of the product, as resulting from the documentation received.
The Customer must return the purchased product within 14 days from the date of the withdrawal communication, carefully packaged, complete with warranty seal (green label – not damaged, nor removed / tampered with), contacting the courier at his own expense. The deadline is considered respected if the customer sends the goods back before the expiry of the 14-day period. The return is at the expense of the customer, who must use a tracked and insured shipping method agreed in advance or booked through our customer service. The Customer must send, within the deadline indicated above, a written communication to the email address: [email protected], providing all the identifying data of the order (name and surname of the buyer; date of purchase; order number; shipping address; date of receipt of the item).
The product must be returned in perfect condition:
1 – Complete with box and warranty 2 – Complete with Warranty Seal (green label – not damaged, removed/tampered with) 3 – In its original packaging, together with a copy of the invoice and the completed return voucher.
After sending the written notice of withdrawal, the Customer must contact a courier at his own expense
The shipment, until the receipt of the goods at the headquarters of Palumbo & Gigante, is under the complete responsibility of the Customer. Palumbo & Gigante is not liable in any way for damage, theft or loss of products that occur during the return shipment by the Customer.
Upon receipt of the shipment, Palumbo & Gigante will video record the opening of the package containing the returned item in order to document the conditions of receipt of the package, the item and the accessories and reveal any damage not caused by Palumbo & Gigante or tampering or replacements with counterfeit products.
Upon completion of the checks, acceptance of the return will be communicated to the Customer by sending a confirmation via email within 7 working days of receipt of the item at the indicated destination.
The refund will include the full value of the returned products. The only costs due by the Customer for exercising the right of withdrawal are the shipping costs incurred at the time of purchase of the products, which will not be refunded.
The refund of the amount paid by the Customer at the time of purchase will take place in the same form chosen by the Customer at the time of purchase.
The refund will be paid to the Customer within 14 days of the communication of acceptance of the withdrawal.
The return of the goods will be accepted exclusively in compliance with the procedure mentioned above and these Conditions of Sale.
In particular, the following is necessary:
The will to exercise the right of withdrawal must be expressed in the manner above described.
The Customer is required to observe the necessary diligence in the care of the product in his possession.
The product must be returned intact, in perfect condition, in the original packaging perfectly intact and complete with all accessories possibly supplied at the time of purchase (warranty, box, case, instructions, etc.), together with the purchase document.
No modifications or customizations must have been made to the product, and the products must not be made to order. In these cases, the right of withdrawal lapses.

APPLICABLE LAW AND REFERENCE REGULATIONS
The sales contract between the Customer and Palumbo & Gigante is deemed to be concluded in Italy and governed by Italian law. For the resolution of any dispute arising from the conclusion of this remote sales contract, the competent court will be that of the place of residence or domicile of the Consumer, as defined pursuant to art. 66-bis of Legislative Decree no. 206/2005. In the event that the Customer is a person other than the Consumer, the exclusively competent court for any dispute that may arise in relation to the sale is the Court of Palermo.
The right for the Customer to resort, in the event of a dispute, to an extrajudicial settlement body (ADR), also operating electronically, pursuant to art. 19 of Legislative Decree no. 70/2003 (any information on this subject can be found at the link:

For anything not mentioned in these General Conditions, express reference is made to the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) – which in articles 51 to 68 regulates distance selling – as well as to the special legislation on e-commerce and the general provisions of the code civil law on sales, where applicable.
